the gun culture that we are. jeff toobin is cnn legal analyst and christian am pan pour is also here, abc's global affairs anchor. this is rooted in the second amendment, jeff. you say it will be determined as much by politics as by law. is gun culture driving politics, politics driving gn culture? does it change? does the second amendment change from here? >> it sure does. the second amendment itself has not changed more than 200 years. but the interpretation of the second amendment has changed dramatically. for more than 100 years, the interpretation was that state militias, that mysterious first clause, they were the only ones who had the right to bear and keep arms. in 2008 the supreme court of the united states said individuals have a right to keep and bear arms. they were talking about handguns in the home. how expansive that right is remains somewhat murky at this point. the idea that you have a constitutional right to bear arms is a legitimate one for better or worse now. that's something that politicians will have to take into consideration as they decide what to do. >> you've po

, psychologist, jeff gardere, also an msnbc news contributor. good to have you here. the kids where you are in newtown are not in school, in fact, they are burying two of their own, two of the 6-year-olds that were lost on friday. millions of parents today are bringing their kids back to school, left with a lot of questions and concerns, wondering is this school going to be safe for them. my sister called me today, my niece and nephew had a lot of questions. she was trying to reassure them and she's left with a heavy heart but she said she was assured by people like you coming on tv trying to help guide them through what they can talk about. so what are you recommending as parents talk to their kids? >> one of the first things i want people to understand is that your children are safe in school. they had more of a probability of being hurt on the ride to school in the car than they do being in school. even at sandy hook, there are approximately 400 children there and sadly, 20 perished but the staff and faculty acted bravely and thoughtfully and saved a lot of lives. so we know that eve

. gin me as former fbi agent jeff lanza, we want to point out he is no relation to adam lanza. security was tight at this school in connecticut. but the gunman was able to get in any way. apparently shooting his way in. is there any way to stop that? >> no place is 100% safe. schools have been in lockdown mode since columbine in terms of the locks and doors they have, buzz-in procedures. that's very important and probably resulted in a lot of people not getting hurt but the problem is, they are never 100% safe. use a gun to break open windows, break open windows other ways, get your hand in and open the door. that's what happened here. no place is 100% secure. >> what about the guns? handguns were found in the school. a rifle in his car. can stronger restrictions on guns prevent these shootings? this opens up the whole gun control debate. where do you stand on that? >> you know, i think -- uncan't make the deaths of these children and the adults to have -- to have less meaning or no meaning at all. it needs to be a legacy and the legacy is congress and the highest levels of government,

page, jess says -- jeff says -- nicholas, what kind of gun do you have? caller: i have two fire armas, an ak-47, and an ar-15 bought as recently as yesterday. host: why did you buy one yesterday? caller: i have wanted one for some time but just didn't. in anticipation of a ban, i made the decision to go out and purchase one. that being said, i want to say i am in favor of huge increases in gun-control law. i think one of the things that is most disturbing to me is to hear fear mongering on both sides of the conversation whether it is coming from anti- gun or pro-gun individuals. what i hear from the pro-gun individuals is that the way to combat crime is to throw more guns at it. i could not possibly disagree more. i think there are some people who should not have guns, definitely should not have guns, this individual involved in the sandy hook tragedy. there are people who should not have the right to. i am in favor of have the background checks. whether the money comes from the gun buyer and the cost goes up in order to get proper background checks done or you just don't buy a gun. i

that are leading this are tom udall from new mexico and jeff merkley from oregon. and you know, the hurdles someone once said that during the 1950s writer was talking about the southern democrats blocking civil rights and they said that the senate was ending revenge for gettysburg and the rules of the senate have lent themselves -- back then, it blocked civil rights but it wasn't a work a day kind of obstructionist. as horrible as it was blocking civil rights legislation. today is it is almost everything. you need 60 votes. it doesn't even -- the majority leader can't even bring a bill up to debate without a 60 votes if the minority wants to force 60 votes. that's got to change. the selection -- the confirmation of federal judges and less than cabinet level appointees, those kinds of things are just obstructionism, period. when in the past, we always were able to just bring it forward to get 51 votes. if you don't, you don't. some of these votes will be more aimed to that. certainly to give the minority rights to slow th
